It is BOTTIMMO's policy to respond to claims of copyright infringement in compliance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), including 17 U.S.C. Section 512, and other applicable law. ## **1\. Notice of Claimed Copyright Infringement** If you are a copyright owner, or are authorized to act on behalf of one, and believe that a copyrighted work has been copied in a way that constitutes copyright infringement occurring through the Services, please deliver a written DMCA notice (a "DMCA Notice") to BOTTIMMO's Designated DMCA Agent at the contact information provided below. Your DMCA Notice must include substantially the following information: 1. Identification of the copyrighted work that you claim has been infringed or, if multiple copyrighted works are covered by a single notice, a representative list of those works; 2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit BOTTIMMO to locate the material on the Services; 3. Information reasonably sufficient to permit BOTTIMMO to contact you, such as your name, mailing address, telephone number, and email address; 4. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; 5. A statement, made under penalty of perjury, that the information in the DMCA Notice is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner; and 6. BOTTIMMO Response to a DMCA Notice** Upon receipt of a substantially compliant DMCA Notice, BOTTIMMO will respond as appropriate under the DMCA, which may include removing or disabling access to the material claimed to be infringing and taking reasonable steps to notify the Customer or User responsible for the material. BOTTIMMO may provide a copy of the DMCA Notice, including the claimant's contact information, to the affected Customer or User or as otherwise appropriate to administer the notice-and-takedown process. ## **3\. Counter-Notification** If material that you submitted has been removed or disabled and you believe that the material was removed or disabled as a result of mistake or misidentification, you may send a written counter-notification (a "Counter-Notice") to BOTTIMMO's Designated DMCA Agent at the contact information listed above. Your Counter-Notice must include substantially the following information: 7. Your physical or electronic signature; 8. Identification of the material that was removed or to which access was disabled and the location at which the material appeared before it was removed or access was disabled; 9. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled; 10. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located or, if your address is outside the United States, for any judicial district in which BOTTIMMO may be found; and 11. A statement that you will accept service of process from the person who provided the original DMCA Notice or an agent of that person. BOTTIMMO may provide a copy of a valid Counter-Notice, including the submitting party's contact information, to the person who submitted the original DMCA Notice. Subject to the DMCA, BOTTIMMO may restore the removed material or cease disabling access to it unless the Designated DMCA Agent receives timely notice that the original claimant has filed an action seeking a court order to restrain the affected party from engaging in infringing activity relating to the material. ## **4\. Misrepresentations** **WARNING:** Under federal law, a person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. The procedures described in this Policy are intended to comply with BOTTIMMO's rights and obligations under the DMCA, including 17 U.S.C. Section 512, and do not constitute legal advice. ## **5\. Repeat Infringer Policy and Other Remedies** BOTTIMMO may suspend, disable, remove, restrict access to, or terminate content, accounts, or Services based on alleged infringement of intellectual-property rights. Without limiting the foregoing, BOTTIMMO may suspend or terminate the accounts of Customers or Users who are determined to be repeat infringers. BOTTIMMO may exercise any additional rights or remedies available under its Terms and Conditions or applicable law, whether or not repeat infringement is involved. ## **6\. Scope and Changes to this Policy** This Policy applies only to notices and counter-notices relating to alleged copyright infringement under the DMCA. BOTTIMMO may revise this Policy from time to time by posting an updated version at the URL identified above and updating the effective date.
